Senior Advocate Applauds Court-Appointed Panel In Hindenburg-Adani Row
Noted legal expert Mukul Rohatgi has welcomed the Supreme Court's move to appoint a committee to look into the issues linked to Hindenburg-Adani row, which has wiped out hundreds of crores in investors' money. The Congress has slammed the decision, insisting that a Joint Parliamentary Committee is the way to go in this matter. The Trinamool Congress, Uddhav Thackeray faction of the Shiv Sena and Arvind Kejriwal's Aam Aadmi Party have expressed support for the court's decision.
Adani Group chief Gautam Adani has already lauded the top court's initiative, tweeting that "truth will triumph". Mr Rohatgi expressed concern that the formation of a Joint Parliamentary Committee will only lead to a "political slugfest".
"Rather than having a Joint Parliamentary Committee and making it a political slugfest, the idea is to look at what are the problems in the system and plug the loopholes," Mukul Rohatgi told NDTV in an exclusive interview.
The shares of the Adani conglomerate nosedived last month after US-based short selling firm Hindenburg Research alleged a financial fraud and stocks manipulation. The Adani Group has strongly refuted the allegations, calling Hindenburg's report a "calculated attack" on India.
Earlier on Thursday, the Supreme Court set up a six-member panel to look into regulatory mechanisms to protect investors' interest. The committee, headed by retired judge Abhay Manohar Sapre, will include veteran bankers KV Kamath and OP Bhat, Infosys co-founder Nandan Nilekani, and retired Justice JP Devdhar
"I think it is appropriate not because of Mr Adani, but because there are millions of share and bond holders, who back particular big businesses. If they have suffered, the court's concern is quite justified," Mr Rohatgi said.
The selection of names is "par excellence" and the remit of the committee is "wide and sweeping," Mr Rohatgi said. "It is the right thing to instill confidence in the market and people who are in the market," he added.
The committee is expected to make an overall assessment of the situation, suggest measures to make investors more aware and help strengthen existing regulatory measures for stock markets, the bench led by Chief Justice of India DY Chandrachud has said.
The investigation by market regulator SEBI (Securities and Exchange Board of India) will run alongside and should be completed within two months, the court said.
Senior lawyer Raian Karanjawala, who represents the Adani Group in several cases, also hailed the formation of the committee.
"It is an excellent decision. The committee meets all the standards that any committee could have met. It has people with high international credentials. The Supreme Court couldn't have chosen a better committee," he said.
He added that he expects it to be an "action-oriented committee" which will give its recommendations "in a forthright matter". "Some part of it might be made public too. People's expectations will be met," he added.
The opposition has been divided over the matter of the committee, with the Trinamool Congress, Uddhav Thackeray and Arvind Kejriwal's Aam Aadmi Party lauding the Supreme Court's decision. On the other side are the Congress and its ally DMK. The Left parties are in a wait and watch mode.
The matter had stalled parliament repeatedly during the budget session, with Opposition parties demanding a probe by the Joint Parliamentary Committee.
The Congress has planned nationwide protests the day parliament resumes.

"In 1986, Rajiv Gandhi granted statehood to Arunachal Pradesh despite Chinese opposition. Later, in 1987, during the military standoff in Tawang, the Indian government ensured that we did not give up our claims along the border. Thus, Indian Army under the leadership of Rajiv Gandhi valiantly fought and pushed back the Chinese," Mr Kharge said.
For the unity, integrity and progress of the country, it is important that the Congress should become strong once again, he said in a statement released here by the Tamil Nadu Congress Committee.
It is only the Congress party that can build a modern and progressive India. "In this fight for building a modern and progressive India, Rajiv Gandhi will always remain a source of inspiration for the Congress party and the youth of our country," he added.

New JNU Rules: Huge Fine For Dharna, Admission Cancellation For Violence
Students can be imposed a penalty of Rs 20,000 for holding dharnas and face admission cancellation or a fine of up to Rs 30,000 for resorting to violence at Jawaharlal Nehru University, its latest rules stipulate.
The 10-page 'Rules of Discipline and proper conduct of students of JNU' has laid out punishments for different kinds of acts like protests and forgery, and procedures for proctorial enquiry and recording a statement.
According to the document, the rules came into effect on February 3. It came after the university witnessed a slew of protests over the screening of a BBC documentary.
The rules document states that it has been approved by the Executive Council, the highest decision-making body of the university.
However, Executive Council members told PTI that the issue was brought as an additional agenda item and it was mentioned that this document has been prepared for "court matters".
The Akhil Bharatiya Vidyarthi Parishad's JNU Secretary Vikas Patel termed the new rules "authoritarian ('tughlaqi')" while asserting that the old code of conduct was sufficiently effective. He demanded a rollback of this "draconian" code of conduct.
JNU Vice Chancellor Santishree D Pandit did not respond to texts and calls from PTI seeking her reaction.
The rules will apply to all students of the university, including part-time students whether admitted before the commencement of these rules or after, the document states.
Punishments have been listed for 17 "crimes" including blockage, indulging in gambling, unauthorised occupation of hostel rooms, use of abusive and derogatory language and committing forgery. The rules also mention that a copy of the complaints will be sent to the parents.
Cases involving both teachers and students may be referred to the Grievance Redressal Committee of the university, school and centre level. Sexual abuse, eve-teasing, ragging, and arousing communal disharmony cases are of the purview of the chief proctor's office.
Chief Proctor Rajnish Mishra told PTI, "There were rules mentioned in the statute. However, the new rules have been formulated after a proctorial enquiry." He did not reveal when this proctorial enquiry started and when asked whether old rules have been modified, she replied in affirmation.
It has proposed punishments for all acts of violence and coercion such as gheraos, sit-ins or any variation which disrupt normal academic and administrative functioning and/or any act which incites or leads to violence.
The punishments include "cancellation of admission or withdrawal of degree or denial of registration for a specified period, rustication up to four semesters and/or declaring any part or the entire JNU campus out of bounds, expulsion, a fine of up to Rs 30,000 as per the old rules, One/two semesters of eviction from the hostel".
If the matter is sub-judice, the chief proctor's office will take action as per the order and direction of the honourable court, the rules state.
For hunger strikes, dharnas, group bargaining and any other form of protest by blocking the entrance or exit of any of the academic and/or administrative complexes or disrupting the movements of any member of the University community, a fine of up to Rs 20,000 will be levied.
According to the old rules, for gheraos, demonstrations and sexual harassment, the proposed punishments were cancellation of admission, rustication and expulsion.
This statute states the university has a proctorial system where the administration of student-related matters about all acts of indiscipline are delegated to the chief proctor. He and she are assisted by proctors. The size of the Proctorial Board is decided by the competent authority.
After receipt of a complaint, it will be scrutinized by the chief proctor who will set up a proctorial enquiry.
"Subsequently, either a one/two/three member(s) proctorial enquiry committee to conduct an in-depth investigation into the matter. Proctorial enquiry is an internal enquiry of JNU and hence, no other person except the Board members is allowed to be present during hearings.
"The accused or complainants is not allowed to be represented by a third party. Similarly, he/she cannot have an observer during the process of enquiry," the document read.
An Executive Council member, who does not wish to be named, said the matter was not discussed at length in the EC meeting and "we were told that the rules have been created for court matters".
Another Executive Council member Brahma Prakash Singh said: "The university might have planned to streamline the process and prepare a full document but it should have been discussed in the EC meeting properly." The ABVP's JNU Secretary Vikas Patel said, "There is no need for this new authoritarian ('tuglaki') code of conduct. The old code of conduct was sufficiently effective.
"Instead of focusing on improvement of safety security and order, the JNU admin has imposed this draconian code of conduct, without any discussion with the stakeholders, especially the student community. We demand its rollback."

US Secretary Of State Antony Blinken Arrives In India To Attend G20 Meet
US Secretary of State Antony Blinken arrived in the national capital on Wednesday night primarily to attend a crucial meeting of G20 foreign ministers that is taking place amid a bitter rift between the West and the Russia-China combine over the Ukraine conflict.
Besides attending the G20 meeting on Thursday, Blinken is expected to hold bilateral talks with External Affairs Minister S Jaishankar. He is also set to attend a Quad foreign ministers' meeting on Friday.
The US Secretary of State arrived in Delhi after a tour of Uzbekistan.
In the Uzbek capital Tashkent, Blinken said Russia's invasion of Ukraine has "fostered deep concern across the region". "After all, if a powerful country is willing to try to erase the borders of a sovereign neighbour by force, what's to stop it from doing the same to others," he said.
"Countries across Central Asia understand this. So does the United States, and so do partners and allies around the world. And that's exactly why we've been committed and remain committed to standing for the sovereignty, the territorial integrity, the independence not only of Ukraine, but for countries across Central Asia and, indeed, around the world," he said at a media briefing.
Russian Foreign Minister Sergey Lavrov, France's Catherine Colonna, Chinese Foreign Minister Qin Gang, Germany's Annalena Baerbock and British Foreign Secretary James Cleverly are among those attending the India-hosted G20 foreign ministers' meeting.
A number of foreign ministers of non-G20 countries, including that of Sri Lanka and Bangladesh, are also attending the meet following India's invitation as guests.
The foreign ministers are also likely to discuss ways to deal with falling economic growth, increasing inflation, lower demands for goods and services as well as increasing prices of food, fuel and fertilisers.
However, the major flashpoint between the West and Russia-China combine is expected to be on the Ukraine conflict even as India is set to make all-out efforts to bring out a joint statement following the crucial meeting.
Russia on Sunday alleged that the G20 finance ministers' meeting in Bengaluru ended without a joint communique because of the "confrontational" approach towards Moscow by the "collective West" over the situation in Ukraine.
The G20 meeting of finance ministers and Central Bank governors on Saturday was unable to come out with a joint communique following opposition by Russia and China on making any references to the war in Ukraine.

Gurugram Man Arrested For Abusing, Making Obscene Gestures At Woman: Cops
A man was arrested for allegedly abusing and making obscene gestures at a woman after he hit her car from behind here on Wednesday, police said.
The man, who was identified as Ansal Dixit (24), a resident of Delhi's Vasant Kunj, allegedly also threatened to kill the woman, they said.
The woman, who works with a private bank, was headed to her office in her car with her driver when Dixit hit the vehicle from behind with his SUV at the Wazirabad traffic signal. Then, the accused stepped out of his car and started misbehaving with the complainant's driver, the police said.
When the woman objected to this, Dixit opened the woman's car door and made obscene gestures at her. He also abused her and threatened to kill her, they said.
The woman informed police on emergency number 112 and a police team reached the spot. Both the man and the woman were brought to Sector 53 police station, where she lodged a complaint, they added.
On the basis of the woman's complaint, an FIR was registered against Dixit under sections 341 (wrongful confinement), 506 (criminal intimidation) and 509 (insulting the modesty of a woman) of the Indian Penal Code (IPC).
"We have arrested the accused and seized his car. We are questioning him," said Station House Officer, Sector 53 police station, Inspector Amit Kumar.
